Do NOT Submit Fraudulent Documents to USCIS — The Consequences Are Serious

By SD Translation Center
Serving Southern California Since 2008
When applying for a U.S. visa, green card, or any immigration benefit, honesty is not optional — it is required. Submitting fraudulent, altered, or misleading documents to U.S. Citizenship and Immigration Services (USCIS) can destroy your eligibility and permanently impact your future in the United States.
At SD Translation Center, we have assisted thousands of clients since 2009. We have seen applicants make mistakes because of fear, misinformation, or poor advice. However, even one fraudulent document can lead to extremely serious and irreversible consequences.
This article explains why you must never submit fraudulent documents to USCIS and what can happen if you do.

1. A Fraud Finding Can Lead to a Lifetime BarIf USCIS determines that you submitted a fake or altered document, you may be found inadmissible under INA §212(a)(6)(C)(i) for “fraud or willful misrepresentation.”
This leads to:
  • ❌ A permanent lifetime ban from entering the U.S.
  • ❌ Denial of your current green card or visa application
  • ❌ Ineligibility for future immigration benefits
Even marriage to a U.S. citizen or having U.S.-born children does not erase this bar. The consequences are severe and long-lasting.

2. Your Immigration Case Will Be DeniedA fraud finding almost always results in:
  • Denial of your pending application
  • Denial of all related filings
  • Increased scrutiny on every future submission
Once your file contains any fraud notation, it remains in your record permanently.

3. You May Be Placed in Removal (Deportation) ProceedingsIf you are physically in the United States when USCIS discovers fraud, you may:
  • Receive a Notice to Appear (NTA)
  • Be placed before an immigration judge
  • Face removal (deportation)
This risk increases if your lawful status has expired.

4. Fraud Can Lead to Criminal ChargesSubmitting fraudulent documents can also violate federal law. Serious cases — such as fake IDs, forged financial documents, false marriage evidence, or identity manipulation — can trigger criminal investigation.
Possible penalties include:
  • Fines
  • Probation
  • Imprisonment
In serious fraud cases, immigration and criminal consequences often overlap.

5. Waivers Are Extremely Difficult, Even When AvailableSome people may qualify for a fraud waiver (Form I-601), but only if they have:
  • A U.S. citizen or permanent resident spouse, or
  • A U.S. citizen or permanent resident parent
And they must prove extreme hardship to that qualifying relative.
Fraud waivers are complex, time-consuming, and never guaranteed.

Common Forms of “Unintentional Fraud”Many applicants commit fraud without realizing what they are doing. Examples include:
  • Submitting photoshopped or modified documents
  • Providing inaccurate translations
  • Altering dates or wording to avoid problems
  • Using documents provided by unqualified agents overseas
  • Submitting employment letters that are not accurate
Even if you did not personally create the fraudulent document, USCIS will still hold you responsible.

Always Remain Honest With USCISEven if your situation is complicated, it is always better to:
  • Explain the truth
  • Provide supporting evidence
  • Consult professionals before submitting
Most truthful issues can be resolved.
Fraud cannot.
